PLANNING AND ZONING COMMISSION
JUNE 22, 2011
A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on June 22, 2011.
The meeting was called to order at 8:27 p.m.

CALL TO ORDER
Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Mary Whaples would be voting in place of Tom Fitzgerald, and Travis Simpson would be voting in place of Paul Roczynski. Additionally, Chairman Kayser stated that the Commission would be voting with seven members.

Upon a motion by John Ryan, seconded by Travis Simpson, the Commission Voted (6-0) to Approve the above minutes. Kathy Salemi abstained from the vote due to her absence from the meeting.

SPECIAL PERMIT USE APPLICATION: Under Section 205.1(d) to allow conversion from filling station repair facility to filling station with convenience store on land located at 1475 Silver Lane.

Applicant: Capital Studio Architects
A motion made by John Grottole to deny the above Special Permit Use Application failed due to a second. Upon a motion by Travis Simpson, seconded by John Ryan, the Commission Voted (6-1) (John Grottole voted in opposition) to Approve the above Special Permit Use Application with the following conditions:
1. Final plans are to signed and sealed by the Professional Engineer and/or Land Surveyor licensed in the State of Connecticut that is responsible for the work.
2. On the Site Plan, add pavement markings and signage to the plan to create a one-way traffic flow pattern in front of the proposed concrete sidewalk.

SITE PLAN APPLICATION –1475 Silver Lane, Installation of new storefront, sloped sidewalk, exterior light and landscaping to an existing filling station.
Applicant: Capital Studio Architects, David Holmes
A motion made by John Grottole to deny the above Special Permit Use Application failed due to a second. Upon a motion by John Ryan, seconded by Peter Bonzani, the Commission Voted (6-1) (John Grottole voted in opposition) to Approve the above Site Plan Application with the following conditions:
1. In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.
2. Final plans are to signed and sealed by the Professional Engineer and/or Land Surveyor licensed in the State of Connecticut that is responsible for the work.
3. Provide a planning and zoning site plan approval block and engineering inspection note on all of the sheets within the plan set.
4. On the Schematic Floor Plan, add dimensions to the length of the proposed ramps and add a detectable warning strip to the ramp where it matches the existing pavement.
5. On the Site Plan, add pavement markings and signage to the plan to create a one-way traffic flow pattern in front of the proposed concrete sidewalk.
6. On the Site Plan, graphically depict the limits of sawcut and pavement repair for the installation of the proposed sidewalk.
7. On the Site Plan, add all necessary construction details including but not limited to sidewalk, signs, light pole and foundation, and pavement repair.
8. On the Site Plan, add a note specifying that all disturbed areas are to receive 6” of topsoil and turf is to be established unless otherwise specified.
9. Provide a photometric plan for the proposed site lighting.

TEXT AMENDMENT APPLICATION – Article VI, Section 601 revised Flood
Hazard Area Regulations and new Federal Emergency Management Agency (FEMA) flood insurance rate mapping (FIRM) in accordance with Title 44 code of Federal Regulations Section 60.3(d).
Applicant: East Hartford Town Planning and Zoning Commission
Upon a motion by Travis Simpson, seconded by Kathy Salemi, the Commission Voted (7-0) to Approve the above Text Amendment Application with an effective date of September 16, 2011.

SITE PLAN APPLICATION – 2 Pent Road, Construction of a new 84,000 square foot four story educational school building, parking lot, and associated storm water drainage system.
Applicant: Goodwin College, Bryant Harrell
Upon a motion by Peter Bonzani, seconded by John Ryan, the Commission Voted (7-0) to Approve the above Site Plan Application with the following conditions:
1. In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.
2. Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the state of Connecticut who is responsible for the work.
3. Provide separate plans for each application and label them accordingly.
4. Provide a planning and zoning site plan approval block and engineering inspection note on all of the sheets within the plan set.
5. Throughout the plan set, revise the building’s address to the tentative street number of 133 High Street that has been created for the proposed building.
6. Throughout the plan set, revise the specification of proposed lot to a lease line or some other specification that is acceptable to the Town Planner.
7. On sheet SS-1.0, add additional detail along with contour labels to the topography on the plan along the southern and western boundaries of the proposed lot so that impacts of proposed site grading to surrounding properties can be evaluated, there also appears to be a 32 contour missing in the vicinity of the electrical substation.
8. On sheet SS-1.0, add notes to specify what is to be done with the existing storage trailers.
9. On sheet L-3.1, clearly specify on the plan what type of retaining wall is to be constructed on the southern property boundary.
10. On sheets L-3.1 & L-3.2, add directional signage for the parent drop off and revise the surface material specification for the proposed speed table so that it appears to be more prominent and more like an extension of the surrounding sidewalk.
11. On sheets L-4.1 & L-4.2, graphically depict the underground stormwater management system and add spot grades to supplement contour information to depict cover necessary to achieve HS-20 loading capacity for the system.

12. On sheets L-4.1 & L-4.2, add top of frame elevations for all proposed utility and drainage structures.
13. On sheet L-4.2, add existing/proposed grade information for the proposed southern curb-line of the access roadway.
14. On sheet L-4.2, add additional existing and proposed contour information and labels adjacent to the western and southern property boundaries. Based upon the information shown, there appears to be low-points created on adjacent properties to the south and west from the proposed grading, add drainage inlets and/or revise the grading to drain any low-areas created by the proposed grading.
15. On sheet C-2.1, revise the plan provide for 3’ minimum cover on plastic piping or revise the pipe material to concrete or metal piping.
16. On sheet C-2.1 revise the location of catch basin 7 to provide more separation to the adjacent retaining wall, revise the location of yard drain 10 to a point outside of the MDC easement.
17. On sheet C-2.1, conduct testpits within the underground stormwater management area to verify the depth to seasonally high groundwater. The testpits are to be witnessed by a representative from the Engineering Department and add the results to the plan. Revise the design of the system accordingly, no credit that will be given for portions of the system located below the elevation of seasonally high groundwater.
18. On sheet C-3.1, graphically depict and specify the sawcut limits and pavement restoration for the work done within the High Street Right-of-way and add the Town of East Hartford permanent patch detail to the plans.
19. On sheet C-3.1, graphically depict and add an easement for electrical infrastructure that is to remain and modifications to the existing electrical substation that is to be relocated.
20. On sheet C-3.1, graphically depict and specify an easement for the installation and maintenance of the proposed site lighting that is located adjacent to the proposed northern property boundary.
21. On sheet C-3.1, add notes to specify the reset of all existing manholes that are to remain within the work area.
22. On sheet C-3.1, add a note to specify that the electric, telephone, and cable service are to be underground from the existing utility pole.
23. On sheet C-5.1, revise the catch basin detail to specify a 4’ deep sump.
24. On sheet SW-2.1, add a note the plan to specify that retaining walls “A” and “B” are to be designed by Geotechnical Civil Engineer Licensed in the State of Connecticut and that shop drawings shall be submitted to the Town of East Hartford Engineering department for review and approval.
25. On sheet SW-3.1, clearly specify which type of wall will be used for the various retaining walls proposed on the site, coordinate the specification throughout the plan set.
26. On sheet ESL-1.1, revise the lighting plan to limit lighting levels at the property boundaries to comply with section 209.6 of the zoning regulations.
27. Within the computations, revise the computations and the plans so that the design information for the storm drainage system and underground stormwater management system coordinate and provide a graphic depicting where the existing storm drainage system to the west will be blocked off.
28. Provide on the plans a specification of where the existing drainage system that the proposed on-site drainage discharges into is to be bulkheaded. Clearly define where each bulkhead will be installed and provide a construction detail.
29. On the plans, provide all necessary construction details for the project. Details shall include but not to be limited to: speed table detail, and the Town of East Hartford permanent patch detail.
30. Site Modification Bond set in the amount of $116,000.00.

SOIL EROSION AND SEDIMENTATION CONTROL APPLICATION – 2 Pent
Road, Construction of a new 84,000 square foot four story educational school building, parking lot, and associated storm water drainage system.
Applicant: Goodwin College, Bryant Harrell
Upon a motion by Travis Simpson, seconded by Peter Bonzani, the Commission Voted (7-0) to Approve the above Soil Erosion and Sedimentation Control Application with the following conditions:
1. Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the state of Connecticut who is responsible for the work.
2. Provide separate plans for each application and label them accordingly.
3. Provide a planning and zoning site plan approval block and engineering inspection note on all of the sheets within the plan set.
4. Throughout the plan set, revise the building’s address to the tentative street number of 133 High Street that has been created for the proposed building.
5. On the site plan, add a note specifying that it was drawn to A-2 survey quality per section 217.3.c of the zoning regulations.
6. On sheet C-4.1, add a map depicting the property boundary and the surrounding area from the site with a radius of ½ mile per section 217.3.b of the zoning regulations.
7. On sheet C-4.1, add NRCS soils to the plan per section 217.3.c.2 of the zoning regulations.
8. On sheet C-4.1, add a signature block per section 217.6 of the zoning regulations.
9. On sheet C-5.5, add a name, telephone number, and other contact information for the individual that will be responsible for the maintenance of the erosion controls during construction and the completed storm drainage system.
10. On sheet C-5.5, add a note to the plan specifying that the contractor shall at all times be prepared to sweep surrounding paved surfaces and shall sweep the surrounding paved surfaces once every two weeks or as directed by the Town Engineer.

Upon a motion by John Ryan, seconded by Peter Bonzani, the Commission Voted (7-0) to Approve the above Site Plan Application with the following conditions:
1. In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.
2. Final plans are to signed and sealed by the professional engineer or surveyor licensed in the State of Connecticut that is responsible for the work.

Upon a motion by Kathy Salemi, seconded by Mary Whaples, the Commission Voted (7-0) to Approve the above 8-24 referral of installation of a new 2” natural gas line.

BOND RELEASES/REDUCTIONS/SETTINGS

Site Plan Modification Bond Release
Applicant: Trinity College
Upon a motion by Travis Simpson, seconded by John Ryan, it was Voted (7-0) to Approve the above request for a bond release in the amount of $10,000.00.
• 478 Burnside Avenue, Medical Office Building
Site Plan Modification Bond Release
Applicant: Shafa Building, LLC
Upon a motion by Travis Simpson, seconded by John Ryan, it was Voted (7-0) to Approve the above request for a bond release in the amount of $13,300.00.
MISCELLANEOUS
Commission reviewed correspondence from Attorney Sheridan dated June 21, 2011 regarding property know as 825 Silver Lane. Property owner Mr. David Caron discussed with the Commission his desire to develop a gasoline station and car wash on the site. After some discussion, it was the consensus of the Commission that a gasoline station and car wash was not appropriate for the area since the existing zoning prohibits both uses.
